Miramichi Valley Baseball League Constitution Table of Contents 1.0 – Name 2.0 – Baseball New Brunswick Affiliation 3.0 – Objective 4.0 – Membership 5.0 – New Franchises 6.0 – Executive 7.0 – Statistician 8.0 – Financial Management 9.0 – Meetings 10.0 – Rules 11.0 – Disputes, Protest, Discipline, and Appeals… 12.0 – Penalties 13.0 – By-Laws 14.0 – Amendments 1.00 Name 1.01 This organization shall be known as the New Brunswick Intermediate Miramichi Valley Baseball League (MVBL) 2.00 Baseball New Brunswick Affiliation 2.01 The League shall be an affiliate of Baseball New Brunswick 3.00 Objective 3.01 The objectives of the League shall be: (A) To promote, govern, and conduct a Intermediate Baseball League in the Province of New Brunswick under the jurisdiction of Baseball New Brunswick (B) To promote and encourage the playing of baseball in a wholesome and entertaining manner 4.00 Membership 4.01 Any Intermediate Baseball Club in good standing with Baseball New Brunswick is eligible for membership, subject to the Constitution and the By-Laws of the League 5.00 New Franchises 5.01 A new franchise may be granted by a three quarter (3/4) of the clubs in good standing at the time the vote is taken. A club is in good standing when it has met the financial commitment and other obligations required by the Constitution and By-Laws of the League. 5.02 An application for admission to the League must be received in writing by the President of the League on or before February 1st. A late entry to the League may be considered with the unanimous consent of member teams in good standing at a meeting called for that purpose. 5.03 The clubs who were members of the League the previous season must be advised by the Secretary-Treasurer of new applications for membership on or before February 5th each year. 6.00 Executive 6.01 The League Executive shall be the League President and One Vice President 6.02 The President of the League shall be elected for One (1) year term at the Annual Meeting 6.03 The President and Vice-President of the League shall not be an official or member of any baseball club or league operating under the jurisdiction of Baseball New Brunswick at the Federation level. 6.04 The President of the League shall appoint the Vice President to replace him during his absence-such appointee to have the powers of the President. 6.05 Vacancies on the Executive that occur between elections shall be filledy appointment made by the President of the League. 6.06 The Vice President shall be elected for one (1) year term at the annual meeting 6.07 The President is responsible for all meetings called and shall chair all meetings. He shall work to promote the game to the best of his ability. 6.08 The President shall only vote at all Executive meetings in case of a tie. 6.09 The President is responsible for all League matters such as schedules, and press releases. 6.10 The President shall rule on umpire reports, example-ejecting a player, coach, manager or on suspensions after he confers with his Executive. 6.11 The President will rule on postponed and forfeit games. 6.12 The President should inspect the fields of teams and attend some games where possible. 6.13 The President and all Executive shall be admitted free to all games (both League and Playoffs) 6.14 The Treasurer is responsible to submitting all League fees to Baseball New Brunswick. 7.00 Statistician 7.01 A League statistician shall be appointed by the President of the League. 7.02 The Statistician shall: (A) At the end of the playing season, compile the final statistics for the year and forward them to each club and the Executive. (B) Submit to each member club a list of players eligible for playoffs according to the Constitution and By-Laws of the League. (C) Perform such duties as determined by the President of the League at the time of appointment. 8.00 Financial Management 8.01 The President of the League shall appoint a Secretary-Treasurer. 8.02 The Secretary/Treasurer shall: (A) Open an account in a Chartered Bank of Canada… (B) Prepare, with the President, the agenda of meetings. (C) Forward to member clubs, the Executive, the Statistician, and other persons determined by the meeting agenda. (D) Write, receive and file all correspondence of the League. (E) Receive all fees, fines, etc., assessed by the League. (F) At the end of each calendar year, present his account book and supporting documents for audit and the preparation of a financial statement. (G) Prepare and maintain the minutes of all League and Executive meetings and shall forward copies of the minutes to all member clubs, and Executive, the Statistician, and other persons named by the President. 9.00 Meetings 9.01 The League Annual Meeting shall be held on the first Sunday of April (depends on Easter), or as advised by the President, except that the Annual meeting is to be held prior to the Annual meeting of Baseball New Brunswick. 9.02 A quorum at the Annual Meeting shall be a majority of voting members. 9.03 A special meeting of the League may be called at any time by the President. 9.04 When the President has received a petition to call a special League meeting signed by not less then three (3) member clubs in good standing with the League, a special meeting shall be held within ten (10) days of receipt of petition. 9.05 The notice of meeting shall be forwarded to all member clubs and the Executive, setting out the time and place of the meeting and the business to be transacted there. 9.06 At a special meeting, the League shall consider only the business set out in written notice calling the meeting unless all the members of the League are present and determined by unanimous consent. 9.07 A quorum at a special meeting shall be three (3) voting delegates representing teams in good standing. 9.08 At all League meetings, voting shall be by voice unless a voting-member requests a ballot vote. 9.09 Each member club in good standing is entitled to one (1) vote. (A) Any team entering our League will be on a probationary period for one (1) year from the date of acceptance, while on probation-clubs may enter into the discussions but will have NO VOTE! (B) Any team not represented at a League meetion shall have no voice in the transactions of that particular meeting. (C) The name of the club voting delegate must be registered at the beginning of each meeting. (D) Two (2) additional non-voting delegates may attend League meetings and speak to matters on the agenda. (E) A team not registering a voting delegate may not have non-voting delegates and shall have no voice in the transactions of business at the particular meeting. 9.10 The President shall vote only to break a tie. 9.11 Motions shall be carried by majority vote. 9.12 The President, or his appointed alternate, shall: (A) Preside at all League meetings (B) Rule on all points of order (C) Be an Ex-Officer member of all committees (D) Order the calling of meetings of the League and the Executive (E) Be responsible for establishing committees and the appointment of executive members to act on committees. 9.13 The agenda for the annual meeting shall have the following format: (A) Presentation of delegate credentials and declaration of the voting delegates (B) Reading of the minutes (C) Business arising from the minutes (D) Presidents report (E) Secretary/Treasurer’s report (F) Committee reports (G) Correspondence (H) Notice of Motion (I) Unfinished Business (J) Election of Officers (K) New Business (L) Adjournment 9.14 The President will call all meetings. 9.15 The President should also call a meeting at the end of the regular completed schedule to confirm the final standings and the League Playoff format, dates, times, etc. 9.16 At the annual meeting all teams should inform the President of which classification their<

MIRAMICHI VALLEY BASEBALL LEAGUE By Laws Table of Contents 1.0 Registration of League 2.0 Registration of Clubs 3.0 Registration of Players 4.0 Fees and Dues 5.0 Official Scorer 6.0 Residence & Eligibility 7.0 League Play 8.0 Team and Individual Awards 9.0 Playoffs 10.0 Protest 11.0 Appeals 12.0 Penalties 13.0 Honorariums 14.0 Amendments 1.0 Registration of League 1.01 The League must register with Baseball New Brunswick on or before May 15th of the playing year to be eligible to conduct league Playoffs for the purpose of declaring a league representive for Provincial Playoffs. League teams will register with Baseball NB for Intermediate (A or B) competition before the deadline established by that organization. Registration fees are the responsibility of member teams. 1.02 The league must file a copy of its constitution and by laws with Baseball NB on or before May 15th of the playing year. 2.0 Registration of Clubs 2.01 Clubs must register for league play by paying their registration fee, due on or before May 15th of the playing year. Upon registration with the league a club must abide by the constitution and by-laws of the league, Baseball NB and Baseball Canada 2.02 All teams must submit the names of their manager and coaches or other contacts of their team with telephone numbers; cell numbers; as well as full mailing addresses; e-mail and fax numbers to league President prior to and no later than May 1st. 3.0 Registration of Players 3.01 A player must sign a registration card each year prior to June 30th to be eligible after the date for play in the league 3.02 A player is eligible to play only for the team which he is registered during the playing season. 3.03 To be eligible for league playoffs, a player must play in six (6) schedule league games played by the team with which he is registered. To play means that the players name appears on the official line-up card for the game involved and the player be present on the bench. 3.04 All teams must have a minimum of fifteen (15) players registered. 3.05 Each member club shall forward to the secretary/treasurer on or before June 30th of each year a registration list of all players and their status. Following the receipt of the player list, the secretary-treasurer will register the player list with Baseball NB 3.06 The league has in place an affiliation agreement. Each team must follow the stated rules. Clubs may affiliate with Junior team, only unless, area has no junior team, then they may affiliate with midget team. (1) League teams must name affiliated teams at time of player registration of each playing year, on appropriate forms (June 30th). (2) With prior agreement of the affiliated team management, all players on identified affiliated teams will be eligible to play a total of six (6) games with the higher classification prior to league playoffs (3) On commencement of intermediate playoffs, teams must designate four (4) affiliated players on appropriate form with each being eligible to play a total of four (4) games in said playoffs. (4) Any affiliated player utilized in any playoff games, must have played at least eight (8) games with his team to be eligible to play. Intermediate team utilizing affiliated players are responsible for verification of above requirements. (5) Affiliated players must meet all eligibility and residency requirements of the MVBL. (6) Use of ineligible affiliated players may result (after investigation by league) in loss of game. Protest must be filed by offended team in usual manner. (7) No player will be contacted directly by higher classification representative. All request for players must come through appropriate lower team management. 3.07 All players become free agents as December 31st of each year. 4.0 Fees and Dues 4.01 Each club shall forward to the league secretary/treasurer on or before May 1st of the playing year a cheque in the amount of _________. (A) Entry fee (to be determined each year) will be used for the opening expenses of the league. (B) A performance bond of ($200). This amount will be returned to the club upon request at the end of the playing season, providing the club has met its obligations. (C) Statistician fee. An amount to be determined each year (currently $80 per team) (D) Insurance fee 4.02 Any team failing to submit entry fee, performance bond, etc (as determined) shall be fined five dollars ($5) per day until such payments are received by secretary/treasurer. 4.03 Money in access of six hundred dollars ($600.00) in the league bank account, at the close of the season may be returned proportionally to member clubs in good standing. 5.0 Official Scorer 5.01 Each member club shall appoint an official scorer who shall fax to the league statistician, game reports and official line up cards, signed by the umpire by the following day, no later then noon, for all games. 5.02 The name and the address of the official scorer of each club shall be registered with the secretary/treasurer and member clubs on or before May 15th of the playing year. 5.03 Official scorers shall be guided by section 10.00 of Baseball Canada Rules 5.04 Teams failing to comply with time frame established in 5.01 will incur a fine of $10 (ten dollars) per game played. 6.0 Residence and Eligibility 6.01 For the purpose of this section on “residence” area means all that region within a fifteen (15) mile radius of a given city, town, or village measured from the nearest boundary point. 6.02 A player is deemed to a resident of an area if he was a resident of the area on or before January 1st of the playing year affected. A player to be eligible for league play and playoffs, is required to be a resident of the area which his club is situated except: (1) A full time student is eligible to play in his place of ordinary residence or in the locality of his studies if he is a resident on June 1st in the area which the club is situated within the meaning of the constitution and by laws of Baseball NB. (2) A player who lives outside the area of an intermediate club may commute to play with any intermediate club. 6.03 All final decisions with regards to eligibility will be the decision of the President with consultation with the Executive. 6.04 Human rights may over rule our league and Baseball NB Executive as well. 6.05 Team managers and players are required to respect the other teams territory (note there are cases that a player can be granted by the league permission to play for another team: (a) working away from his home area (b) his manager will not play him. 6.06 A player playing one (1) game for a team is a property of that team unless it is against the league constitution. A player being released by a team must have approval to play for another team. 6.07 Players who played for a team outside his home area the previous year may still play for the same team if he wishes, even if his home team enters the league. If he wishes not to play for the same team; he must play for his home team. 6.08 A new player wishing to play in the league must play for his home team; unless being released by his home team: League will approve 6.09 A player leaving a team to play in another league is still the property of his home team, if he returns to the MVBL 6.10 A player may appeal to the league executive for his release if his present team does not play him. The Executive has the right to decide after checking stats etc. of said player. If his team refuses to release him they will be suspended from the league. All players have the right to play. 6.11 All players must return uniforms and equipment to his manager upon request. He is not permitted to play for another club unless doing so. The manager should collect all uniforms, equipment, etc, at the end of the season. 7.0 League Play 7.01 A club should have no more than twenty-one (21) players on the b
